These Terms and Conditions apply when you use deoxy.co.uk and when you buy goods from DEOXY. Please read them before placing an order.

Nothing in these terms limits any rights that you have as a consumer under applicable law.

2. The website and these terms

By using this website you agree to use it lawfully and not to interfere with its operation, security or the rights of other people.

We may update these terms from time to time. The terms that apply to an order are the terms made available to you when you place that order, subject to any rights the law gives you.

3. Products

We take reasonable care to describe and display products accurately. Colours can look different depending on screens, lighting and photography. Minor variations that do not materially change the product may occur.

Product measurements and size guides are provided to help with selection. Unless a product is expressly made to your specifications, choosing a standard size does not by itself make the product personalised.

4. Prices

Prices are shown in pounds sterling unless stated otherwise. The price shown to you will be the product price payable, inclusive of VAT where VAT applies. Delivery charges and any other unavoidable charges that apply to your order will be shown before you submit the order.

We try to ensure prices are accurate. If there is an obvious pricing or description error, we may contact you before accepting or dispatching the order so that you can confirm whether you wish to proceed at the correct price, or we may cancel and refund the affected order.

5. Placing an order and contract formation

When you submit an order, you are offering to buy the goods shown in your order. An automated order acknowledgement confirms that we have received the order but does not necessarily mean that we have accepted it.

Unless we tell you otherwise, the contract for goods is formed when we confirm dispatch of the relevant goods. We may decline an order before acceptance, including where a product is unavailable, payment cannot be authorised, there is a material pricing error or we reasonably suspect fraud or unlawful activity.

6. Payment

Payment is processed through Shopify and the payment methods made available at checkout. You must be authorised to use the payment method supplied.

7. Availability, launch stock and pre-orders

All orders are subject to availability. DEOXY may release products in limited quantities or small production batches.

Where a product is sold as a pre-order, this will be made clear before purchase together with the expected timing information available to us. Estimates can change because of production, customs, transport or other events outside our reasonable control. If a material delay occurs, we will provide any cancellation or refund rights required by law and may offer additional options at our discretion.

8. Delivery

Available delivery services, charges and estimates are shown at checkout or in our Delivery information.

Unless another delivery period is agreed, consumer goods should normally be delivered without undue delay and no later than 30 days after the contract is made. Your rights where delivery is late are governed by applicable consumer law.

Risk of loss or damage normally remains with us until the goods are delivered into your physical possession, or to a person you identify to receive them, except where the law provides otherwise.

9. Your right to cancel an online order

Consumers buying online normally have a statutory right to cancel qualifying goods without giving a reason. The cancellation period is generally 14 days beginning the day after you, or a person you nominate, receives the goods. Different timing rules can apply to orders containing multiple goods delivered separately.

To exercise the right to cancel, you must send us a clear statement before the cancellation period expires. You can email hello@deoxy.co.uk or use the model cancellation form in our Returns & Refunds policy.

After cancelling, you must normally return the goods within a further 14 days.

10. Return costs and refunds after cancellation

Unless we agree otherwise, you are responsible for the direct cost of returning goods when you cancel because you have changed your mind. This does not apply in the same way where goods are faulty, incorrect or not as described.

For a valid cancellation, we will refund the price of returned goods and, where applicable, the cost of the least expensive standard outbound delivery option offered for the order. We do not have to refund any additional cost of a premium delivery option beyond the standard delivery amount.

We may withhold a refund until the goods are returned or you provide evidence of return. We may also make a lawful deduction where handling beyond what would reasonably be permitted in a shop has diminished the value of the goods.

Refunds are made without undue delay and within the statutory time limits. Please see our Returns & Refunds policy for the practical process.

11. Exceptions to change-of-mind cancellation

The statutory right to cancel does not apply to every type of product. Examples can include goods made to a consumer’s specifications or clearly personalised, and sealed goods not suitable for return for health protection or hygiene reasons after the seal has been broken.

Any relevant exclusion will be made clear where it applies. These exceptions do not remove your rights where goods are faulty, misdescribed or otherwise fail to meet legal requirements.

12. Faulty or misdescribed goods

Goods must be of satisfactory quality, fit for purpose and as described. The Consumer Rights Act 2015 gives consumers remedies where goods do not meet those standards, including a short-term right to reject qualifying faulty goods within 30 days in many circumstances and further rights to repair, replacement, price reduction or refund.

13. Promotions and discount codes

Promotions may have additional conditions, including opening and closing dates, qualifying products, exclusions and limits on combining offers. Unless stated otherwise, promotions have no cash value and cannot be applied retrospectively to completed orders.

We may withdraw or correct a promotion where there is an obvious error, fraud, abuse or a technical problem, while respecting orders and consumer rights that have already become binding.

14. Intellectual property

The DEOXY name, branding, graphics, photography, designs, website content and other intellectual property on this site are owned by or licensed to DEOXY unless stated otherwise.

You may use the website for personal shopping and informational purposes. You must not reproduce, commercially exploit or misuse protected content without permission or another lawful basis.

15. Reviews, submissions and communications

If you submit reviews, photographs or other content to us, you must have the right to submit it and it must not be unlawful, misleading, abusive or infringe another person’s rights.

Where we wish to reuse customer-created content for marketing outside the functionality you used to submit it, we will seek any permission required by law or by the relevant platform terms.

16. Our responsibility to you

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability that cannot be excluded under consumer law.

We are not responsible for business losses suffered by consumers, because our goods and website are supplied for private and domestic use. Nothing in this paragraph limits rights that the law gives you.

17. Events outside our reasonable control

We are not responsible for delay caused by events outside our reasonable control. If a significant delay affects an order, we will contact you where reasonably possible and take the steps required by law, including giving you any applicable right to cancel.

20. Governing law and courts

These terms are governed by English law. If you are a consumer resident in the United Kingdom, you retain the benefit of any mandatory protections that apply where you live and may bring proceedings in the courts available to you under applicable law, including the courts of England and Wales, Scotland or Northern Ireland as relevant.
